Sula Terms of Use

These Terms of Use ("Terms") are an agreement between you and Jack Steelberg, an independent developer based in Arizona, USA ("Sula", "we", "us", "our"), for your use of the Sula app and its related services (together, the "Service"). Please read them. By downloading, installing or using Sula, you agree to these Terms and to our Privacy Policy at https://mynd-iphone.vercel.app/privacy. If you do not agree, please do not use Sula.

1. Who can use Sula#

You must be at least 13 years old to use Sula. If you are under 18, or under the age of majority where you live, you may use Sula only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf. Sula is not directed to children under 13.

2. Your account#

You can use Sula with or without an account. If you create one, with Sign in with Apple or with an email address, you are responsible for keeping your sign-in details private and for activity under your account. Tell us at our support address — Support email opens with the App Store launch — if you think someone else has access to it.

You can delete your account at any time in Settings → Your data → Delete my account. What happens to your data is explained in the Privacy Policy.

3. What Sula does#

Sula is a personal assistant and memory for your own use. You talk or type to it; it saves what you say on your iPhone, organizes it into your day, threads, notes and timeline, and answers your questions using what you have told it. With your permission, it can also read your Favorites photos, sleep data from Apple Health, your calendars, birthdays from your contacts, and your approximate location for weather.

To reply, answer and organize, Sula uses artificial intelligence provided by third parties (currently Anthropic and Google), as described in the Privacy Policy. Sula asks for your permission before sending anything to them. AI features need an internet connection, Sign in with Apple, and a plan (or one of your free answers).

We are always improving Sula, so features may be added, changed or removed over time. If we remove a major paid feature, we will tell you in advance.

4. Your content#

"Your content" means everything you give Sula: what you say and type, photos you send from Sula's camera, text and files you import, and anything else you add.

  • You own your content. These Terms do not give us ownership of anything you put into Sula.
  • Permission to run the Service. You give us a limited, worldwide, non-exclusive, royalty-free permission to store, process and transmit your content only as needed to provide Sula to you, including sending it to our AI providers as described in the Privacy Policy. This permission ends when you delete the content or your account, except for copies our providers keep for a limited time under their terms.
  • We do not use your content to train AI models, and we do not sell it.
  • Your responsibility. You are responsible for your content, and you confirm you have the right to give it to Sula. Take care with information about other people, such as photos of them or messages they sent you; use it in a way that respects their privacy and the law.

5. AI output#

Sula's replies, answers, summaries, briefings, stories and organizing are produced by artificial intelligence. Please keep these points in mind:

  • AI can be wrong. It can misunderstand you, mix things up, put an event on the wrong day, miss something, or state something false with confidence. Check anything important, especially dates, times, amounts and names.
  • Not professional advice. Sula does not give medical, mental health, legal, financial, tax or other professional advice, even if it talks about those subjects. Sleep information and the "Your day" read, including mood, are for your own reflection only. They are not a diagnosis or treatment. Always ask a qualified professional about decisions that matter.
  • Not for emergencies. Do not rely on Sula in an emergency. If you or someone else is in danger, contact your local emergency services.
  • Not a guaranteed reminder. Reminders and calendar entries depend on your phone, your settings and the AI understanding you correctly. Do not rely on Sula alone for anything where a missed reminder could cause harm, such as medication.
  • You decide. You are responsible for what you do with Sula's output.

6. Plans, subscriptions and payment#

6.1 Free answers#

Every install of Sula includes 5 free answers so you can try it. Without a plan after that, everything you say is still saved. Sorting and replies pick up again with a plan.

6.2 Plans#

Sula offers auto-renewing subscriptions in one subscription group, called Sula. Prices below are in US dollars; prices in other countries are shown in the App Store before you buy and may include local taxes.

On every plan, capturing and sorting what you say is unlimited, and you can take photos with Sula's camera and have them filed. Photo answers and understanding in chat come with Sula Plus and Sula Max. "Replies and answers" means Sula's replies in conversations, answers when you pull down to ask, and photo reads. Monthly allowances reset on the first day of each calendar month, and unused replies do not roll over.

6.3 Subscription terms#

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Your subscription automatically renews for the same period and at the same price unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours before the end of the current period.
  • You can manage your subscription and turn off auto-renew in your Apple ID account settings after purchase (on iPhone: Settings → your name → Subscriptions).
  • Deleting Sula or your Sula account does not cancel your subscription.

6.4 Free trial#

Sula Plus Yearly includes a 7-day free trial for people new to the Sula subscription group. If you do not cancel at least 24 hours before the trial ends, it converts automatically to a paid Sula Plus Yearly subscription at $79.99 per year (or the local price shown to you), charged to your Apple ID. Any unused portion of a free trial is forfeited when you purchase a subscription. Apple allows one introductory offer per subscription group per Apple ID.

6.5 Changing plans#

You can move between plans in Settings → You → Change plan or in your Apple ID subscription settings. Apple decides when a change takes effect: moving to a higher plan usually starts right away with a prorated refund of the old plan, and moving to a lower plan usually starts at your next renewal date.

6.6 Price changes#

If we change a subscription's price, Apple will notify you in advance as its rules require. Where Apple requires it, a price increase will not apply to you until you agree to it; if you do not agree, your subscription will end at the close of the current period.

6.7 Refunds#

All purchases are processed by Apple, so refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com. We cannot issue refunds directly.

6.8 Fair use#

Sula Max includes unlimited replies and answers within fair use, which means up to 5,000 replies and answers a month, far more than one person normally uses. If an account reaches that, replies and answers pause until the next month, while saving and sorting carry on, and the app says so. To keep the Service working well for everyone, our server also limits how many AI requests any one account can make in a day, on every plan; normal personal use stays well under it. Automated or scripted use is not normal personal use.

6.9 One person per plan#

Plans are for one person and are not shared through Family Sharing.

7. Acceptable use#

Use Sula for your own lawful, personal purposes. Do not:

  • Break any law, or use Sula to harm, harass, threaten, stalk or spy on anyone.
  • Give Sula content you do not have the right to use.
  • Use Sula to create content that sexually exploits minors, promotes violence or terrorism, or facilitates serious harm.
  • Try to get around plan limits, share your account, resell the Service, or use automated means (bots, scripts) to access it.
  • Reverse engineer, decompile or interfere with the app, our server or our providers' systems, except where the law allows it despite this restriction.
  • Use Sula or its output to build a competing AI product, or to extract our providers' models or data.
  • Break the usage policies of our AI providers (Anthropic and Google), which also apply to what you send through Sula.

We may suspend or end access for anyone who seriously or repeatedly breaks these rules.

8. Other services#

Sula works with services we do not control, including Apple (Sign in with Apple, Health, Photos, Calendar, Contacts, speech recognition, Maps and the App Store), our AI providers, Open-Meteo for weather, and any AI assistant you bring an answer over from. Your use of those services is governed by their own terms and policies, and we are not responsible for them. If one of them changes or stops working, some Sula features may change or stop working too.

9. Our intellectual property#

Sula, including its design, software, name and logo, belongs to us and is protected by law. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable license to use the Sula app on Apple devices you own or control, as permitted by the App Store's Usage Rules. If you send us feedback or ideas, we may use them without any obligation to you.

10. Apple#

If you got Sula from the App Store, these Terms are in addition to Apple's Licensed Application End User License Agreement (www.apple.com/legal/internet-services/itunes/dev/stdeula/). In addition:

  • These Terms are between you and us, not Apple. We, not Apple, are responsible for Sula and its content.
  • Apple has no obligation to provide maintenance or support for Sula.
  • If Sula fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Sula.
  • We, not Apple, are responsible for addressing any claims relating to Sula or your use of it, including product liability claims, claims that Sula fails to meet legal or regulatory requirements, and consumer protection, privacy or similar claims.
  • If anyone claims that Sula or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and once you accept them, Apple may enforce them against you.

11. Ending these Terms#

You can stop using Sula at any time and delete your account in Settings → Your data. We may suspend or end your access if you seriously or repeatedly break these Terms, if the law requires it, or if we stop offering Sula. If we stop offering Sula altogether, we will give reasonable notice where we can, so you can keep what is on your phone. Sections 4 (your responsibility for your content), 5, and 9 through 16 continue after these Terms end.

12. Disclaimers#

Sula is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that Sula will be uninterrupted, error-free or secure, that AI output will be accurate or complete, or that your data will never be lost. Your data is stored on your phone, so keep your iPhone backed up. Some places do not allow certain warranty disclaimers, so some of this section may not apply to you.

13. Limitation of liability#

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, missed appointments or reminders, or decisions made based on AI output, arising from or related to Sula, even if we were told such damages were possible.
  • Our total liability for all claims relating to Sula is limited to the greater of (a) the amount you paid for Sula in the 12 months before the claim arose, or (b) US $50.

Some places do not allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that cannot be limited by law.

14. Indemnity#

To the extent permitted by law, you agree to defend and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your content, your misuse of Sula, or your breach of these Terms.

15. Governing law and disputes#

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict of law rules. If you have a problem with Sula, please contact us first at our support address — Support email opens with the App Store launch; most things can be sorted out quickly, and we will try in good faith for 30 days before either of us goes further. Any dispute that is not resolved informally will be decided exclusively by the state or federal courts located in Arizona, and you and we consent to their jurisdiction. Either of us may instead bring an individual claim in small claims court if it qualifies.

If you are a consumer living in the European Union, the United Kingdom or another country whose laws give you the right to bring claims in your home courts or under your home laws, nothing in this section takes those rights away.

16. General#

  • Changes to these Terms. We may update these Terms. We will change the effective date above and, for significant changes, tell you in the app before they take effect. If you keep using Sula after that, the new Terms apply.
  • Entire agreement. These Terms, the Privacy Policy and, where applicable, Apple's Standard EULA are the whole agreement between you and us about Sula.
  • Severability. If any part of these Terms cannot be enforced, the rest stays in effect.
  • No waiver. If we do not enforce a right right away, we have not given it up.
  • Assignment. You may not transfer these Terms to anyone else. We may transfer them as part of a sale or reorganization of Sula, and will tell you if that happens.
